1. Definitions

  • "We," "Our," "Us" refers to Equinox.
  • "You," "Your" refers to the user, customer, or visitor of our website and services.
  • "Services" refers to our commercial printing, graphic design, web design, promotional merchandise, clothing, photography, and social media marketing services.

2. Use of Our Website

  • You must be at least 18 years old to use our services.
  • You agree not to use our website for any unlawful purpose or in a way that may harm our reputation or operations.
  • We reserve the right to modify or discontinue any part of our website without notice.

3. Orders and Payments

  • All orders are subject to acceptance and availability.
  • Prices are displayed in GBP and are subject to change without notice.
  • Payment must be made via our accepted payment methods: Bank Transfer, GoCardless.
  • We reserve the right to cancel orders due to errors in pricing or product availability.
  • Ownership of Goods: All goods remain the property of Equinox until full payment has been received.
  • Late Payments: If payment is delayed beyond agreed terms, additional charges may apply.

4. Artwork, Revisions, and File Submission

  • Revisions & Approvals: Revisions and approvals will be agreed upon with each job individually. Approvals must always be in writing.
  • Ownership & Copyright: Ownership and copyright will always remain with Equinox. However, the client will also have the same rights once full payment has been received.
  • Project Timelines & Delays: Project timelines will be discussed and agreed upon individually. If clients cause delays that are deemed unacceptable, extra costs may be incurred.
  • Client Responsibility: Clients must always confirm the final proof, and they will be responsible for any errors in artwork or order specifications. Equinox will not be liable for any mistakes.
  • File Setup: Clients must adhere to our file setup guidelines. Equinox is not responsible for errors resulting from incorrect file preparation.
  • Promotional Use: Unless otherwise stated in writing by the client, Equinox reserves the right to use completed client work for marketing and promotional purposes, including but not limited to our website, social media, and advertising materials.
  • Storage: We do not guarantee indefinite storage of client artwork. It is the client's responsibility to maintain backup copies of their files.

5. Shipping and Delivery

  • We use third-party carriers, including DPD, Royal Mail, FedEx, Parcel Force, DX, APC, and a pallet network service.
  • Delivery times are estimates and not guarantees. We are not responsible for delays caused by shipping providers.
  • Risk of loss passes to you upon delivery to the carrier.
  • Product Availability: Equinox will provide specifications from suppliers, but the client is responsible for selecting size and color. Clients must accept that variations in size and color may occur.
  • Failed Deliveries & Redelivery Costs: If a delivery is unsuccessful due to incorrect information provided by the client, additional delivery charges may apply.

6. Order Cancellations & Changes

  • Cancellations or changes must be made before production begins. If production has started, full or partial charges may still apply.

7. Claims & Quality Disputes

  • Any claims for defective, damaged, or incorrect goods must be reported within 24 hours of receipt.
  • Faulty goods must be returned before a refund or reprint is issued.
  • Minor variations in print color, materials, or finishing are considered industry standard and are not grounds for a refund or reprint.

8. Photography Services

  • Ownership & Copyright: Equinox will hold all rights, as well as the client, once full payment has been received.
  • Cancellations & Rescheduling: Cancellations and rescheduling may incur extra charges if sufficient notice is not provided.

9. Social Media Marketing Services

  • Scope of Responsibility: Depending on the nature of the job per client, Equinox may be responsible for part or all of the social media marketing process.
  • Account Access: Equinox will require dedicated access to client accounts to ensure we do not hold client details.
  • Performance Disclaimer: Equinox does not guarantee any performance, metrics, or results.

10. Limitation of Liability

  • We are not liable for indirect or consequential damages arising from the use of our services.
  • Our maximum liability is limited to the amount paid for the specific order in question.
  • Equinox is not responsible for any loss of income or revenue resulting from delays, errors, or service disruptions.

11. Indemnification

  • You agree to indemnify, defend, and hold harmless Equinox, its employees, agents, and affiliates from any claims, liabilities, damages, and expenses (including legal fees) arising out of your use of our services, violation of these terms, or infringement of any third-party rights.

12. Force Majeure

  • We are not responsible for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, supplier failures, technical failures, government actions, or acts of God.

13. Governing Law

  • These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the United Kingdom. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the UK courts.

14. Privacy and Data Protection

  • Your personal data is collected and used in accordance with our Privacy Policy.
  • By using our website, you consent to our data processing practices.

15. Changes to Terms

  • We may update these Terms and Conditions at any time. Continued use of our services after changes are made constitutes acceptance of the new terms.
